1. Website Presentation

The website appartcity.com (hereinafter the “Website”) is the exclusive property of SAS Appart'City (hereinafter the “Publisher”), a simplified joint-stock company (SAS) with a share capital of €41,234,551.18, registered with the Montpellier Trade and Companies Register under number 490 176 120 (intra-community VAT number: FR 30 490 176 120), whose registered office is located at 125, rue Gilles Martinet – CS 10007, 34277 Montpellier Cedex 3, France. The Website’s Publishing Director is Mr. Vincent Compagnon, in his capacity as Chairman of the Management Board of SAS Appart'City.

2. Terms of Service

The minimum configuration required to access the Website is as follows: a screen resolution of 1024x768 pixels, Microsoft Internet Explorer 9.x or Mozilla Firefox 34.x browser software.

Users acknowledge that they have verified that the computer equipment used does not contain any viruses and is in perfect working order.

Users acknowledge having been informed that the Website is accessible 24 hours a day, 7 days a week, except in cases of force majeure, computer difficulties, telecommunications network issues, or technical difficulties. For maintenance purposes, the Publisher may interrupt access to the Website and will endeavor to inform users in advance.

The Publisher and its service providers disclaim any liability for difficulties encountered when accessing the Website and shall not be held liable for any direct or indirect damages that may result from access to or use of the Website, including inaccessibility, data loss, deterioration, destruction, or viruses that may affect users’ computer equipment and/or the presence of viruses on the Website.

Users declare that the cost of accessing and browsing the Website is their sole responsibility. If users access the Website from a country other than France, they agree to ensure compliance with locally applicable legislation.

3. Information contained on the site

The information provided on the Website is for informational purposes only. The Publisher and its partners cannot guarantee the accuracy, completeness, or timeliness of the information published on the Website. While every effort is made to provide users with available and verified information and/or tools, the Publisher and its partners shall not be held liable for errors or omissions and/or lack of availability of information and services.

Consequently, users acknowledge that they use such information under their sole responsibility, and the Publisher declines all liability for any inaccuracies or omissions relating to information present on the Website.

4. Personal data

In accordance with the provisions of French Law No. 78-17 of January 6, 1978 on Data Processing, Data Files, and Individual Liberties, the automated processing of personal data implemented within the framework of the Website has been declared to the French Data Protection Authority (CNIL).

Users are informed that they have the right to access, modify, rectify, and delete data concerning them, which they may exercise:

Users are informed that, in accordance with Article 27 of the Law of January 6, 1978, personal information communicated by users through forms on the Website is intended for the Publisher. Users may object to this transfer by sending a letter to the address mentioned above.

Personal data that users may be required to provide is provided voluntarily, particularly through Website forms or participation in a game. This information is necessary for the Publisher to manage user files. If users do not provide the required information, the Publisher will not be able to process such files. For evidentiary purposes, the Publisher may confidentially store and archive user data.

Unless expressly agreed by the user (electronic consent), collected data will not be rented, exchanged, or transferred to companies outside the SAS Appart'City group.

5. Cookies

In accordance with Directive 2002/58/EC, the Publisher uses cookies to simplify the use of forms and analyze website traffic in order to improve the quality of the Website. A cookie is a data block that does not identify users but records information relating to users’ actions and navigation on the Website.

Users are informed that during visits to the Website, cookies related to browser software may be automatically installed on the computer(s) used.

Unless browser settings are adjusted or action is taken by the user, cookies remain stored for five (5) years on the computer(s) used to consult the Website. Browser settings can be configured to notify users of cookies and potentially refuse them (users should refer to their browser’s instructions for the relevant procedure). Users may delete cookies at any time via their browser’s privacy options, noting that Website functionality may be limited as a result.

As part of online advertising programs, the Publisher and third-party providers, including Google, jointly use first-party cookies (such as Google Analytics cookies) and third-party cookies (such as DoubleClick cookies) to collect information about users’ browsing paths on the Website, optimize and display advertisements on third-party websites based on visits made to the Website, determine relationships between recorded visits and ad impressions, and analyze interactions with such advertisements and advertising services.

Users may disable Google Analytics advertising features and customize ads displayed on Google’s Display Network via the Google Ads Preferences Manager.

Users have the right to access, modify, rectify, and delete personal data collected via cookies under the same conditions as described in Section 4. Personal information concerning users is intended for the Publisher.

6. Compliance with Legislation and Liability

The Publisher informs users that all applicable laws and regulations are enforceable on the Internet. Users are required to comply with the provisions of the Law of January 6, 1978 relating to data processing, data files, and individual liberties, violations of which may result in criminal penalties. Users must refrain from any misuse of personal data they access and, more generally, from any act that may infringe upon privacy or reputation.

The Publisher owns or holds rights to the Website’s general structure, architecture, software, texts, images (animated or not), graphics, sounds, and all elements composing the Website. Any reproduction, representation, modification, publication, transmission, alteration, total or partial, of the Website or its content, by any means and on any medium, is prohibited.

Any unauthorized use of the Website, its content, and/or information disclosed therein shall incur the user’s liability and constitute infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.

The same applies to databases that may appear on the Website, which are protected under the Law of July 1, 1998 transposing the European Directive of March 11, 1996 on the legal protection of databases into the French Intellectual Property Code. Any reproduction or extraction will incur user liability.

The Publisher’s trademarks and logos displayed on the Website are registered trademarks. Any reproduction or representation, total or partial, of these trademarks or logos, alone or combined with other elements, without prior written authorization from the Publisher is prohibited and shall incur user liability under Articles L.713-2 and L.713-3 of the French Intellectual Property Code.

Users agree, under penalty of civil and/or criminal liability, not to use the Website to:

• transmit any content containing programs, codes, viruses, or similar elements intended to damage or limit Website functionality;

• transmit unlawful or harmful content via interactive tools, including insulting, defamatory, degrading, pornographic, or irrelevant messages;

• transmit any content violating intellectual property rights, industrial property rights, or personal rights.

The Publisher reserves the right to immediately remove, without prior notice, any content that violates applicable laws and regulations.

Users wishing to use any Website content (text, image, etc.) must obtain prior written authorization from the Publisher by contacting the Webmaster or Publishing Director.

7. Hyperlinks

Hyperlinks to other Internet resources, including partners, have been subject to prior authorization. However, as the Publisher cannot control third-party website content, it cannot be held liable for the content, layout, or data collection practices of such websites. Users may not create hyperlinks to the Website without prior written authorization from the Publisher.

8. Management of Usernames and Passwords

Certain interactive areas of the Website require a username and password (notably “My Account”).

Users are responsible for managing and safeguarding their credentials. The Publisher shall not be held liable for any fraudulent use of usernames or passwords.

9. Intellectual property

The Website is governed by French and international copyright and intellectual property laws. Reproduction of all or part of the Website, in electronic or paper form (including downloadable documents), is strictly prohibited without prior express authorization from the Publishing Director.

10. Photo credits

All visuals on the Website are reserved rights. Photos and illustrations are non-contractual. Some visuals may originate from various sources and image banks such as Adobe Stock.

11. Applicable law in the event of a dispute

The present terms are governed by French law. French courts have sole jurisdiction for any dispute relating directly or indirectly to access to the present Site or its use.

12. Accessibility

Appart'City is committed to making its websites accessible in accordance with Article 47 of Law No. 2005-102 of February 11, 2005.

This accessibility statement applies specifically to https://www.appartcity.com.

Our Commitment and Website Redesign

The redesign of https://www.appartcity.com/ was carried out with particular attention to digital accessibility. The development team was trained in best practices and RGAA requirements to integrate accessibility from the design and development stages.

Compliance Status

Not all pages and functionalities have yet been evaluated under RGAA 4.1.2. A full audit is scheduled for March 5, 2026.
