1. presentation of the site

The website appartcity.com (hereinafter “the Site”) is the exclusive property of SAS Appart’City (hereinafter “the Editor”), a simplified joint stock company with a share capital of 4 904 705,6 Euros, registered in the Montpellier Trade and Companies Register under number 490 176 120 (intra-community VAT number FR 30 490 176 120) and whose head office is located at the following address: 125, rue Gilles Martinet - CS 10007, 34077 Montpellier, FRANCE. As Managing Director of SAS Appart’City. Mr. Vincent Compagnon is the Site’s Development Director.

The following companies have contributed to the development of the Site:

  • graphics layout, technical execution and hosting: C2iS, headquartered at 103 rue Vauban - 69006 Lyon, FRANCE
  • SEO consultancy: Cybercité, headquartered at 78, Boulevard du 11 Novembre - F-69100 Villeurbanne, FRANCE

The Site may provide access to other websites that may or may not belong to the Editor, and which are likely to be governed by their own legal notices, which should be consulted and respected.

The user of the Site acknowledges that he/she has the skills and means necessary to access and use the Site.

 

2. conditions of service

The minimum system requirements needed to access the Site are the following: 1024x768 pixels screen resolution and Microsoft Internet Explorer 9.x or Mozilla Firefox 34.x browser software. The user of the Site acknowledges that he/she has checked that the computer system being used contains no viruses and is in perfect working order.

The user acknowledges that he/she has been informed that the Site remains accessible 24 hours a day and 7 days a week, except in cases of force majeure or difficulties relating to IT, the telecommunications networks or technical issues. In order to carry out website maintenance, the Editor may interrupt access to the Site and, in such cases, will make every effort to notify users in advance.

The Editor and his providers do not accept responsibility for any difficulties encountered when accessing the Site and cannot be held responsible for any direct or indirect damages that could result from access to or use of the Site, including inaccessibility, loss of data, deteriorations, destruction or viruses that could affect the user’s computer equipment, and/or the presence of viruses on the Site.

The user declares that the cost of accessing and browsing the Site is at his/her sole charge. Should the user access the Site from outside of France, he/she agrees to ensure compliance with all applicable local legislation.

 

3. information contained on the site

The information provided on the Site is for reference purposes only. The Editor and his partners cannot guarantee that the information on the Site is accurate, complete and up-to-date. The Editor and his partners make every effort to provide the user with information and/or tools that are available and verified, but cannot be held responsible for mistakes or omissions and/or a lack of availability of information and services.

Consequently, the user acknowledges that he/she is solely responsible for his/her use of this information, and the Editor does not accept responsibility for any possible inaccuracies or omissions relating to the information provided on the Site.

 

4. personal information

In accordance with the provisions of Act n°78-17 of 6th January 1978 pertaining to Data Processing, Data Files and Individual Liberties, the automated processing of personal data executed within the framework of the Site has been declared to the French National Commission for Information Technologies and Civil Liberties (the CNIL).

The user is informed that he/she is entitled to access, change, correct and delete any personal information, and that he/she can exercise this right:

  • either by sending an email to: dpo@appartcity.com,
  • or by posting a request to: SAS Appart'City - 125, rue Gilles Martinet - CS 10007, 34077 Montpellier, FRANCE.

The user is informed that, in accordance with Article 27 of the Act of 6th January 1978, any personal information communicated by the user via the forms appearing on the Site is intended for the Editor. The user is entitled to oppose this transfer of information by posting his/her request to the above-mentioned address.

When prompted, notably when completing forms on the Site or to take part in a game, the user provides his/her personal data on a voluntary basis. This information is required by the Editor to follow up on individual cases. Should the user fail to provide the required information, the Editor will be unable to deal with these cases. For the purposes of evidence, the Editor may confidentially preserve and archive the user’s data.

Barring the express permission of the user (via electronic acceptance), the data collected will not be rented, exchanged or handed over to any companies outside of the SAS Appart’City group.

 

5. COOKIES

In accordance with the provisions of directive 2002/58/CE, the Editor uses cookies to simplify the use of forms and to facilitate the analysis of visitor traffic in order to improve the quality of the Site. Cookies are blocks of data that do not allow the user to be identified, but which serve to record information relative to the user’s actions and browsing activity on the Site.

The user is therefore informed that, when he/she visits the Site, cookies linked to the browser software may be automatically installed on the computer(s) used.

Unless otherwise specified in the browser settings or due to the user’s actions, the cookies will remain stored on the computer(s) used to visit the Site for a period of five (5) years. Browser settings can be configured to alert the user when a cookie is being stored, giving him/her the opportunity to accept or refuse the cookie (the user should refer to the browser operating manual for details on the procedure to follow). The user can choose at any time to delete the cookies by accessing the privacy options of his/her browser, knowing that this may restrict his/her use of the Site.

As part of the development of online advertising programs, the Editor and third-party providers, including Google, collectively use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) to obtain clickstream data on the Site user, to optimise and publish adverts on third-site websites in accordance with the number of times the user has visited the Site, to determine the correlation between the number of recorded visits to the Site and the impressions of adverts, other uses of advertising services and interactions with these impressions of adverts and advertising services.

The user can at any time deactivate the Google Analytics functionalities for display advertising, and personalise the adverts appearing on the Google display network via the Google Ads preferences questionnaire.

The user is entitled to access, change, correct and delete any personal  information communicated via the cookies under the same conditions as those set out in point 4. All private information concerning the user is intended for the Editor.

 

6. legislative compliance and responsibility

The Editor informs the Site users that all laws and regulations in force apply to the Internet. In particular, users of the Site are required to comply with the provisions of the Act of 6th January 1978 pertaining to Data Processing, Data Files and Individual Liberties, the contravention of which is liable to criminal prosecution. As they are accessing personal data, they must also refrain from collecting or misusing this data and, in a more general sense, from acting in any way that may potentially infringe on the private life or reputation of others.

The Editor is the owner of, or holds the rights to, the Site’s general structure, the webspace, the software, the texts, the images (whether animated or not), the graphics, the sounds, and more generally all the elements that make up the Site. Any complete or partial reproduction, representation, modification, publication, distribution or alteration of the Site or of its content, by any procedure and on any medium whatsoever, is forbidden.

Any unauthorised use of the Site, of its contents and/or the information present on the Site is the responsibility of the user and will constitute an infringement punishable under Article L 335-2 et seq. of the French Intellectual Property Code.

The same applies to any databases featuring on the Site, which are protected by the provisions of the Act of 1st July 1998 adapting the Intellectual Property Code to incorporate the European Directive of 11th March 1996 concerning the legal protection of databases.

Accordingly, any reproduction or extraction of these databases will engage the liability of the user. The Editor’s brands, as well as the logos featuring on the Site, are registered trademarks. Any partial or total reproduction or representation of these brands or these logos, on their own or integrated within other elements, without the Editor’s express and prior authorisation, is prohibited and will engage the liability of the user in accordance with articles L 713-2 and L 713-3 of the French Intellectual Property Code.

The user agrees, under the penalty of his/her civil responsibility being engaged, not to use the Site in order to:

  • transmit by any process whatsoever (email or others) any content including programs, codes, viruses, etc. intended to destroy or limit the functionalities of the Site,
  • transmit by any means whatsoever (email or others) via the interactive tools available on the Site, any illegal or harmful content, in particular messages that are of an abusive, offensive, defamatory, derogatory, degrading or pornographic nature, or that are unrelated to the themes presented,
  • transmit, by any means whatsoever, any content in contravention of intellectual and industrial property rights, individual personality rights, etc.

As regards the Site’s interactive tools, the Editor reserves the right to delete immediately and without prior warning content of any nature, and in particular any messages, text, images, graphics, etc. in contravention of the laws and regulations in force and notably the regulations described above.

Should a user wish to use content from the Site (text, images, etc.), he/she agrees to request the Editor’s prior and written authorisation, by writing or sending an email to the webmaster or to the Site’s Development Director.

 

7. hyperlinks

Hyperlinks placed on the Site leading to other online resources, and notably to partner websites, have been the subject of prior authorisation. However, as the Editor cannot control the content on these third party sites, under no circumstances will he assume responsibility for either the availability or the content featuring on or obtained via sites accessed in this way, or for any collection and transmission of personal data, installation of cookies or any other process in support of the same ends, carried out by these sites. Under no circumstances can the Site’s users and visitors post a hyperlink to the Site without the Editor’s prior and written authorisation. Any request to this end must be addressed to the Site’s Development Director.

 

8. usernames and passwords

Access to certain interactive features on the Site may require a username and a password (in particular “My Account”).

The user is responsible for managing and saving his/her usernames and passwords. Consequently, it is up to the user to take all the necessary precautionary measures in order to save and protect his/her usernames and passwords. The Editor can in no way be held responsible for any fraudulent use of the usernames and passwords belonging to the Site’s users.

 

9. intellectual property

French and international legislation on copyright and intellectual property applies to the Site. The reproduction in full or in part of the Site on any electronic or paper medium (including downloadable documents) is strictly prohibited, without the express prior authorisation of the Site’s Development Director.

 

10. photo credits

The visual images that appear on the Site are all rights reserved. The photographs and illustrations are not contractual.

 

11. applicable law in the event of a dispute

The present terms are governed by French law. French courts have sole jurisdiction for any dispute relating directly or indirectly to access to the present Site or its use.

The original version of these terms is written in French. In the event of any conflict or inconsistency between the French version and a translated version, the French version will prevail.
